The Civil Guard uncovers a plot dedicated to multiply protected plant varieties (16/04/2015)

The Civil Guard in the region of Murcia has developed the operation 'ROYALTY' research aimed at clarifying the cultivation of fruit varieties, whose reproduction and multiplication is subject to payment of the fees to the patentee, which has resulted in imputation of four people on suspicion of offense against intellectual property.

They have also been seized 4,500 plants in Jumilla.

Last January, the Nature Protection Service (SEPRONA) began the investigation when he learned that in farms of Jumilla and Abarán, was producing varieties of nectarines and patented apricots and recorded by a research company in the sector, no permission.

Given the suspicions that these crops were doing through channels other than those regulated and evading the payment of the fees, the Civil Guard has had the collaboration of a subsidiary of the National Association of Plant Breeders, to study these fruit in order to determine, after analysis, if the plant material corresponded with registered products.

The comparison of the obtained samples has determined that it is patented and subject to payment of royalties varieties, which has uncovered a network aimed at cultivating registered without proper payment of fees, in which four people appear related products.

On the one hand three owners of farms in Jumilla and Abarán who allegedly facilitated the plant material to a nursery Jumilla, where a fourth person appears related to the alleged reproduce them.

After obtaining the necessary evidence Guardia Civil has indicted four people one woman and three men, Spaniards, aged between 42 and 65 years who are credited with authorship of the alleged offense against intellectual property.

Also, have been taken over 4,500 plants.

The proceedings initiated and the seized have been made available to the Court of First Instance and Instruction No. 1 of Jumilla (Murcia).

In the investigated case refers to the reproduction and economic benefits through the exploitation of protected plant varieties, without the consent of the owner of a plant variety right of, a crime he may be punished with imprisonment of six months to two years.

This practice constitutes unfair competition in the sector, in addition to direct harm to the research company, with costly investments, improve the quality and production of agricultural products reach our tables.
